Normative legal acts regulating licensed activities

Licensing requirements and conditions for the implementation of the licensed activity, imposed on the license applicant, licensee, and special licensing requirements and conditions are specified in Chapter 28 “Activities related to the production of alcoholic, non-food alcohol-containing products, non-food ethyl alcohol and tobacco products” of the Regulation on licensing of certain types of activities, approved by the Decree of the President of the Republic of Belarus of September 01, 2010 No. 450.

The production of alcoholic, non-food alcohol-containing products, non-food ethyl alcohol, state registration of the main technological equipment for the production of these types of products is carried out in accordance with the Law of the Republic of Belarus of August 27, 2008 No. 429-З “On State Regulation of the production and circulation of alcoholic, non-food alcohol-containing products, non-food ethyl alcohol".

The list of main technological equipment for the production of alcoholic, non-food alcohol-containing products, non-food ethyl alcohol is specified by the Resolution of the State Committee for Standardization of the Republic of Belarus of October 20, 2008 No. 50 “On approval of the list of main technological equipment for the production of alcoholic, non-food alcohol-containing products and non-food ethyl alcohol subject to state registration”.

The application form for the state registration (re-registration) of the main technological equipment is approved by the Resolution of Gosstandart No. 65 of October 16, 2012. № 65.

Types of metering devices for alcoholic, non-food alcohol-containing products and non-food ethyl alcohol by type of production, as well as the starting date of the use of such devices by legal entities, are approved by the Resolution of the Council of Ministers of the Republic of Belarus of October 26, 2005, No. 1185.

The accounting procedure for alcoholic, non-food alcohol-containing products and non-food ethyl alcohol, using metering devices is carried out in accordance with the Resolution of the Council of Ministers of the Republic of Belarus of October 28, 2005. No. 1194.

Requirements for accounting, storage, release and transportation of ethyl alcohol are specified by the Regulation on the accounting procedure, storage, release, acceptance, inventory and transportation of ethyl alcohol obtained from food raw materials, rectified ethyl technical alcohol and industrial alcohol obtained from food or non-food raw materials, approved by the Resolution of the Council of Ministers of the Republic of Belarus of December 23, 2004 No. 1633.

The production of tobacco products is regulated by the Decree of the President of the Republic of Belarus of December 17, 2002 No. 28 “On State regulation of production, circulation, advertising and consumption of raw tobacco and tobacco products”.

Registration of the main technological equipment for the production of tobacco products is carried out in accordance with the Regulation on the State registration of the main technological equipment for the production of tobacco products, approved by the Resolution of the Council of Ministers of the Republic of Belarus of November 08, 2005 No. 1235.

The List of the main technological equipment for the production of tobacco products is approved by the Resolution of the Committee for Standardization, Metrology and Certification of the Council of Ministers of the Republic of Belarus of June 09, 2004 № 24 "On approval of the list of main technological equipment for the production of tobacco products, subject to state registration".

The procedure of the disposal of alcoholic, non-food alcohol-containing products, non-food ethyl alcohol and tobacco products leftovers in cases of termination or cancelling of license validity is determined by the Instruction on the procedure of marketing of the alcoholic, non-food alcohol-containing products, non-food ethyl alcohol and tobacco products leftover in case of termination or cancelling of special authorization (license for activities), connected with the production of alcoholic, non-food alcohol-containing products, ethyl alcohol and tobacco products, approved by the Resolution of State Committee for Standardization of the Republic of Belarus and the Ministry for Taxes and Duties of the Republic of Belarus of January 11, 2010 № 69/81.

Alcoholic, non-food alcohol-containing products, non-food ethyl alcohol and tobacco products are manufactured in accordance with technical normative legal acts in the field of technical norm setting and standardization, technological documentation for the product type (group), the production of which is specified in the license.
